LICENSE AGREEMENT
License Agreement
This License agreement is between the installing agency and the Florida Department of Transportation and the FAMU-FSU College of Engineering, hereafter referred to as the TraCS team. The TraCS software license is owned by the Iowa Department of Transportation and is licensed by the Florida Department of Transportation on a no-cost basis for the purpose of collecting transportation data. TraCS-based forms specific to the state of Florida have been developed by the TraCS team with funding from the Florida Department of Transportation. TraCS can produce timely and accurate crash data that agencies can use to manage their traffic safety problems. The TraCS Team is committed to developing and testing methods for electronic transmission of crash and citation data to the Department of Highway Safety and Motor Vehicles and to the Florida Department of Transportation.
Ownership and Grant of License
The TraCS team is providing the enclosed software to installing agencies provided they are willing to accept all of the terms in this licensing agreement. Please read the terms carefully before installing the software, because by installing this software, you are agreeing to be bound by the terms of this agreement. The enclosed software program and the accompanying written materials are owned by the licensors and are protected by United States copyright laws. By accepting this agreement, you do not become the owner of the software, but you have the right to use the software in accordance with this agreement. The software is provided with no warranty regarding performance. The TraCS team disclaims all other warranties, and will in no event be liable for damages arising out of your use or inability to use the software.
Restrictions on Use and Transfer
The licensors grant you the right to install and use the software on any number of machines or networks within the agency. You may not copy, distribute, or transfer the software beyond those locations granted in this license without permission of the TraCS team. You may not modify, reverse engineer, decompile, or disassemble the software. You may use the Software Development Kit to enhance existing TraCS-Florida forms or to develop new forms for use by your agency. The TraCS team will be notified of any modifications or new forms, and any modified or newly developed forms will be shared with the TraCS team upon request.
Responsibilities of TraCS team and Installing Agency
Any equipment provided by the TraCS team to the installing agency is provided with subgrant funding from the Florida Department of Transportation. This equipment is provided to the installing agency for use in piloting the TraCS software and TraCS-Florida forms. This equipment is to be used as specified by the TraCS team, for the collection, management, and/or dissemination of TraCS-based transportation data. The agency will be responsible for the purchasing of consumable items such as paper, ink cartridges, batteries, pens, etc. The agency agrees to procure all required hardware that they do not own or do not receive from the TraCS team.
The installing agency agrees to install and use TraCS software for issuing Florida Uniform Traffic Citations and completing Florida traffic crash reports and other forms as supplied by the TraCS team. The agency agrees to designate agency contact(s) for: problem resolution, transmission issues, training (initial and ongoing), and make appropriate personnel available for training. The agency agrees to provide feedback to the TraCS team on request, including copies of all collected data (ADVDATA.MDB and other data files). This data will only be used for research, testing, and development purposes, and will not be released to the general public. Any publication of the data will only be in aggregate form, with all personal driver data and other identifying information removed.
When equipment is available, the installing agency agrees to locate crashes using the GIS Location Tool or GPS device. When electronic data transmission to DHSMV and/or FDOT is available, the agency agrees to submit all required data (crash and/or citation data) electronically in accordance to procedures to be established by DHSMV, FDOT, and the TraCS team, inasmuch as the agency is able.
